This page (together with the documents referred to on it) tells you the terms and conditions ("Terms & Conditions") on which we supply any of the products ("Products") listed on our website www.theperfumeshop.com (the "Site") to you. Please read these Terms & Conditions carefully before ordering any Products from the Site. You should understand that by ordering any of the Products, you agree to be bound by these Terms & Conditions. You can print a copy of these Terms & Conditions by selecting the print option from the "File" menu of your browser. Please also note that the use of the Site is subject to the terms contained in the Disclaimer and Terms of Use, which apply whether or not you order any Products from the Site.
We take privacy seriously. The categories of personal data that we process depend on how you use our services. We use your personal data to align our online and in store services with your preferences, to provide you with purchases and services, to deal with your requests, to contact you regarding tailored products and services which may be of interest to you, to provide prize draws or competitions, or to carry out relevant administrative services. 1. Information about us
The Site is operated by The Perfume Shop Limited ("we" / "us"). We are registered in England and Wales under company number 02699577 and with our registered office at Hutchison House, 5 Hester Road, Battersea, London, SW11 4AN. Our VAT registration number is GB 582 8392 03.
2. How the contract is formed between you and us
2.1 You may place an order to purchase a Product advertised for sale on the Site by following the onscreen prompts after clicking on the item you are interested in. You will have an opportunity to check and correct any input errors in your order up until the point at which you submit your order by clicking the "Proceed to Secure Payment" button on the "Payment Details" page.
2.2 After placing an order, you will receive an e-mail (the "Order Confirmation") from us acknowledging that we have received your order and giving an order number and a summary of your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (the "Dispatch Confirmation"). The contract between us will only be formed when we send you the Dispatch Confirmation for the relevant Product.
2.3 The contract will relate only to those Products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Dispatch Confirmation.
2.4 We may choose not to accept your order for any reason and we will not be liable to you or to anyone else in those circumstances.
2.5 We may be unable to process your order if:
- The Product you ordered is out of stock or discontinued;
- OR
- There is a problem with authorisation of your method of payment.
3. Delivery
3.1 We will deliver the Products to you in accordance with the delivery option specified by you when you placed your order (e.g. Standard Delivery, Express Delivery, or Click & Collect).
3.2 We will dispatch all Products comprised in your order which are supplied by us at the same time albeit on some occasions in multiple packages. Delivery will be made to the delivery address specified in your order. Please see Delivery Information for details of where we deliver and the available delivery options. We cannot deliver items within the same order to multiple addresses. We are not responsible for any additional carrying or positioning of Products ordered.
3.3 Click & Collect: If you choose to collect your order from a store using Click & Collect, the available stores for collection will be listed when you select this delivery option. You will be notified by text if you have provided a mobile number when your order is ready for collection, please note that you will be unable to collect your order earlier than the date or time notified. You must bring your order number, the card used to pay for the order and a form of photo ID. To protect you against fraud, we will not be able to give you your order unless you provide these documents on collection. If someone else is collecting the Products for you, they must bring your order number and their photo ID. Whilst we make every effort to have your order ready for collection at the date and or time notified, we will not be liable if we fail to do so in part or in full for circumstances beyond our control. Your order will be available for collection at your chosen store for 10 calendar days, after which time it will be returned to us and your account refunded. It may take up to 30 days to process your refund after we have received the returned Products.
3.4 You must be logged in on the website with a registered rewards club card in order to qualify for our free VIP Members Standard Delivery. Your order value must be €50 or above in order to qualify for free VIP Members Standard Delivery.
4. Risk and Ownership
4.1 Once delivered, the Products ordered will become your responsibility and, except in relation to Products that are damaged or faulty when delivered or have been incorrectly delivered, we will not accept any liability for their loss, damage or destruction after they have been delivered.
4.2 Ownership of the Products will only pass to you on: delivery of the Products to you; or us receiving full payment of all sums due in respect of the Products, (including delivery charges) whichever is the later.
5. Price and Payment
5.1 The price of any Products will be as quoted on our Site from time to time, except in cases of obvious error.
5.2 These prices include VAT but exclude delivery costs, which will be added to the total amount due once you have selected a delivery service from the available options as set out in Delivery Information.
5.3 Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.
5.4 We cannot complete your order until you have paid for it in full. Payment can be made by most major credit or debit cards and PayPal by completing the relevant details on the "Payment Details" page.
5.5 By using a credit/debit card or PayPal to pay for your order, you confirm that the card/account being used is yours. All fields indicated as compulsory must be completed. You further agree and consent that we may mask and convert your credit/debit card information to a unique token via the tokenisation process. The generated token is saved in a secure way and would be used for your future transactions with us. Your actual credit/debit card information is not stored on our servers or retained by us. Please note that we will only use your information in accordance with our *Privacy Policy*. All credit/debit card/PayPal account holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment we will not accept your order and we will not be liable for any delay or non-delivery and we are not obliged to inform you of the reason for the refusal. We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card/PayPal payment in accordance with your order. You may have the right to seek assistance and redress through the Financial Ombudsman, if you paid by credit card.
5.6 Our Site contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on our Site may be incorrectly priced. We will rectify any such errors as soon as possible once we become aware of them. If a Product's correct price is different from the price stated on our Site, we will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your order and notify you of such rejection.
International Payment and Deliveries
5.7 We only accept payment in Euros by credit or debit card & PayPal.
5.8 If an exchange rate is applicable to your order your card provider will determine the rate of exchange and may add an administration charge which you will be liable to pay.
5.9 The contract between us for the items you have ordered will only be formed when we email you to confirm that the items have been dispatched. The contract will therefore be formed in England and the language of the contract will be English.
5.10 All refund payments will be paid to you in Euros and will match the amount you paid in Euros for the item(s) and delivery (if the delivery charge is refundable). If an exchange rate is applicable to your order the amount you receive in your local currency will depend on the exchange rate applied by your credit or debit card provider when it receives our refund payment and may therefore be different from the price paid for the item(s) in your local currency. We will not be liable for any losses caused to you as a result of any currency fluctuations or exchange rates applied by your credit or debit card provider.
6. Our cancellation, returns and refund policy
6.1 Except in relation to the products specified in the next paragraph, you may return your order (or any part of it) up to 90 days after the products have been delivered to you. Please refer to the return’s procedure for online orders or by contacting our Customer Services team at help@theperfumeshop.com.
6.2 You may not cancel your order if the Products are (i) personalised for you; or (ii) perishable items (e.g. food) unless such Products were damaged or faulty when delivered to you or have been incorrectly delivered.
6.3 Where you decide to cancel an order after we have dispatched the Products, you will be under a duty to return them to us, at your own risk. We will not be responsible for any loss or damage to the Products in transit. All such Products should be returned within 90 days after the Products have been delivered to you. Until such time as they are returned, you must retain possession of the Products and take reasonable care of them. You should return the Products to us unused and in the same condition in which you received them together with the original Product packaging, by one of the means set out in our Returns Procedure.
6.4 After you cancel your order and return the Products, any sum debited by us to your credit/debit card/PayPal will be refunded in full (including the cost of delivery if you paid for delivery). We may make a deduction from the reimbursement for loss in value of any Products if the loss is a result of unnecessary handling by you. We will notify you of your refund via e-mail within a reasonable period of time. We will usually refund any money received from you using the same method originally used by you to pay for your purchase except PayPal returns in store. Refunds for Products purchased as gifts can only be given to the credit/debit card of the person who placed the order. We will process the refund due to you as soon as possible and, in any case, within the earlier of (a) 14 days of the day we receive back the Products from you; (b) 14 days of the day you provide us with evidence that you have returned the Products; or (c) where no Products were dispatched 14 days of the day you provide your notice to cancel the order.
6.5 If any Product you purchase is damaged, faulty or incorrect, when delivered to you we may offer an exchange or refund as appropriate, in accordance with your legal rights. If you believe a Product is faulty, you should return the Product to us in accordance with the Returns Procedure. If you have any questions regarding returns, please Contact us.
6.6 If you have reason to return a Product received using the Click & Collect service, you must return the Product either by post in accordance with the Returns Procedure on the Dispatch Confirmation, or return it in person to one of our stores or our Head Office, together with the original Product packaging. If you decide to use one of our stores to return the Product, the store will return that item on your behalf and if the Product is eligible for a refund, the refund will processed in-store. We will usually refund any money received from you using the same method originally used by you to pay for your purchase. If you decide to return the Product by post or to our Head Office, the refund will usually be processed as soon as possible and, in any case, within the earlier of (a) 14 days of the day we receive back the Products from you; or (b) 14 days of the day you provide us with evidence that you have returned the Products. If the Product you are returning is not faulty, e.g. you ordered an incorrect item, and you choose not to return the item via one of our stores, we are not responsible for the postage or delivery charges in connection with the return of the Product.
6.7 Our policy on cancellations, returns and refunds does not affect your statutory legal rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013. If you have further questions regarding your legal rights please contact your local Citizens’ Advice Bureau or your local Trading Standards Office.
7. Try Me Sampling
7.1 Try me is a complimentary service which allows you to try a sample size version of a Product before you open the packaging. This service will be advertised on the relevant Product page and will be sent automatically to you with your order, subject to availability.
7.2 If after trying the sample, by any chance you don’t like the Product, please return it unopened within 90 days for a full refund. Please see our full Returns, Exchanges & Refunds Policy.
8. Product Personalisation (Engraving & Monogramming)
8.1 Items that have been personalised in any way cannot be returned for an exchange or refund, unless the item is faulty.
8.2 Your personalised message will be applied in a predetermined position on your product. This is to ensure you have the maximum number of characters available. Where possible messages are engraved on the back of the bottle. If this is not possible (due to factors such as shape or material) a secondary position will be chosen.
8.3 Please double-check your order on screen carefully to check that all the details are correct before submitting your order. It is up to you to ensure that the personalised message is correct, accurate and is correctly spelt. You are responsible for ensuring that any wording that you request to be personalised is correct and accurate and does not infringe the intellectual property rights or other rights of any third party or contain anything that is obscene, indecent, vulgar, offensive, blasphemous, scandalous, defamatory, or otherwise inappropriate or which may cause distress or discomfort to the recipient. We cannot accept personalised messages with emojis, symbols or words that may be deemed as inappropriate or offensive. These will be removed from your message and the product will not be personalised.
8.4 All Products ordered for engraving or monogramming are removed from their cellophane in order for them to be personalised. This does not affect the quality of the product inside.
8.5 We reserve the right to switch off products from either the engraving or monogramming service at any time depending on demand.
9. Gift Wrap
9.1 We are unable to refund gift wrap or personalised ribbon charges if your product is unwanted or you have changed your mind.
9.2 You may enter up to 60 characters for your personalised ribbon message. Your message will be printed in a single line, in gold lettering and will repeat to fill the full length of the red satin ribbon. We will choose the most appropriate length of ribbon for your gift.
9.3 Please double-check your order on screen carefully to check that all the details are correct before submitting your order. It is up to you to ensure that the personalised ribbon message is correct, accurate and is correctly spelt. You are responsible for ensuring that any wording that you request to be personalised is correct and accurate and does not infringe the intellectual property rights or other rights of any third party or contain anything that is obscene, indecent, vulgar, offensive, blasphemous, scandalous, defamatory, or otherwise inappropriate or which may cause distress or discomfort to the recipient. We cannot accept personalised messages with emojis, symbols or words that may be deemed as inappropriate or offensive. These will be removed from your message and the ribbon will not be personalised.
9.4 We reserve the right to switch off products from the gift wrap service at any time depending on demand.
10. Our liability
10.1 We are under a legal duty to supply Products that are in conformity with the contract. We accept no liability for any loss which is not reasonably foreseeable or for any business loss (which includes loss of profits, contracts, goodwill, opportunity and other similar losses).
10.2 This does not include or limit in any way our liability for death or personal injury caused by our negligence, or our responsibility for fraudulent misrepresentation and any other liability that cannot, under English law, be excluded.
10.3 Nothing in this section 10 or elsewhere in our Terms & Conditions affects your statutory legal rights.

Any formal legal notices should be sent to us at our Customer Services address set out in the Contact Us section.
12. Events outside our control
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events outside our reasonable control.
13. General
13.1 If any of these Terms & Conditions are declared invalid, unlawful or unenforceable, then that provision shall be deemed to be deleted from these Terms & Conditions and the remaining provisions shall remain in full force and effect.
13.2 We have the right to revise and amend these Terms & Conditions from time to time without prior notice by changing them on the Site, provided that any such change will not affect any purchases you have made before the change is implemented.
13.3 Failure by us to enforce a right does not result in waiver of such right. You may not assign or transfer your rights under these Terms & Conditions.
13.4 You and we agree that English law applies to these Terms & Conditions and that any dispute between us arising out of or in connection with these Terms & Conditions will only be dealt with by the English courts, unless you are resident in another part of the United Kingdom or the Republic of Ireland, in which case the applicable law of that part of the United Kingdom or the Republic of Ireland will apply and any dispute will be brought before the courts there. We are required by law to inform you that purchases can be concluded in English only and that no public filing requirements apply.

Privacy Policy
General
- These terms and conditions govern your membership of VIP Rewards and the use of your VIP Rewards card. They also set out the terms of the contract between The Perfume Shop Limited ("us"/ "we") and you ("you"/ "your"). Please read them carefully and keep hold of a copy for future reference. If you have any questions about these terms and conditions or your membership of VIP Rewards, then please contact Customer Services.
- VIP Rewards is only open to residents of the United Kingdom or Republic of Ireland who are at least 14 years old. If you are 14 or 15 years old, you must obtain your parent or guardian's consent before you apply to join VIP Rewards. Only one membership per person/email address is permitted. Membership is not open to companies, partnerships, unincorporated associations or similar entities. Members who are 14 or 15 years old can enjoy the promotional benefits of VIP Rewards but will not receive any marketing communications unless they have confirmed that they have their parent or guardian’s consent to receive such marketing communications.
- Membership of VIP Rewards is personal to you. You may not share or transfer promotions, although your friends and family can apply for their own VIP Rewards card.
- We may refuse an application to join VIP Rewards if we feel there is a good reason to do so.
- You can pick up your VIP Rewards card in-store or create a digital VIP Rewards card online. As soon as you have your card, you can enjoy select member benefits, for example our exclusive member promotions. However, some benefits (such as A List Extras, birthday and favourite brand offers) require you to activate and register your VIP Rewards card and provide additional information. You can activate your VIP Rewards card either in-store or online at www.theperfumeshop.com.
- When you join VIP Rewards, all the mandatory fields must be completed for us to activate your account. If you activate your VIP Rewards card online the mandatory fields will be shown highlighted.
- You must notify us as soon as possible if you change your name, address or email address, by making the changes online at www.theperfumeshop.com or contacting Customer Services. Please note that if you do not let us know of these changes, you may miss out on promotional offers and your use of your VIP Rewards card may be affected if, for example, someone else registers for the VIP Rewards at your old address.
- Your account will remain active if you use your VIP Rewards card at least once in any rolling 36 month period. If you fail to use your VIP Rewards card within this period any offers will be forfeited, and your account will be closed.
- By accepting these terms, you confirm that you are happy to receive news and offers tailored just for you as explained in Section 6 of our Privacy Policy.
- You will receive news from us and trusted partners (such as companies in the A.S. Watson Group or C.K. Hutchison Holdings Group) by email, SMS, direct mail and other communication methods – as chosen by you.
- You also consent to our use of beauty product related information for marketing purposes as explained in the Privacy Policy, if you purchase (online or in-store) products using your VIP Rewards card for such purchases.
- At any time, you can opt out of all such marketing and withdraw your consent in ‘My Account’ or directly in the communications you receive. Opting-out will not affect the other services you receive as part of VIP Rewards.
- You will access A List Extras based on your spend in-store, online or on The Perfume Shop app over a consecutive 12 month period. This will be automatically calculated and updated every time you shop. In-store your VIP Rewards card must be presented at the checkout before you pay and online you need to have your valid VIP Rewards card linked to your online account. If you do not have your VIP Rewards card with you, keep your receipt and contact Customer Services who will be able to update your spend balance.
- Gift cards, carrier bags, delivery costs, gift bags and gift boxes will not be calculated as part of your VIP Rewards spend and will not count towards your total consecutive 12 month spend.
- There are three A List Extra levels enabling VIP Rewards card holders access to exclusive products, offers and events. Level rewards are subject to availability, while stock lasts. Access to levels is based on total spend at The Perfume Shop within the last consecutive 12 month period.
- Entry to each level is subject to the following spend within the last consecutive 12 month period:
(a) €100 – 199.99 to access level 1;
(b) €200 – 299.99 to access level 2;
(c) €300 - 399.99 to access level 3; and
(d) €400 plus will allow you additional entry into any relevant level. For example, if your total spend is €500 you would qualify for level 3 and an additional reward at level 1. - When you reach a level, you have the choice of whether to redeem that level, or to continue working towards the next level.
- When you redeem a level, the value of that level (€100, €200 or €300) will be taken away from your consecutive 12 month spend balance. Your rolling spend balance will be recalculated to reflect any remaining spend balance – for example if you have €150 spend balance and you redeem level 1, your spend balance will be reduced by €100 to €50; or if you have €500 spend balance and you redeem one level 3 and one level 1 offer, your spend balance will be reduced by €400 (€300 + €100) to €100.
- From time to time, we may run special promotions to allow access to level rewards outside of your current level.
- The available products, offers and events within each level will vary. Typically, the following may be included but this is subject to change.
- If you return a product this spend will be deducted from your spend balance.
- Please retain your receipts. We may request them from you if, for example, you have any queries regarding your spend balance, or where we reasonably suspect fraudulent activity or a breach of these terms and conditions.
- Present your VIP Rewards card in-store or check your online account to see your current spend balance and level eligibility.
- Please note your spend balance can take up to 48 hours to update after purchase. For online orders spend balance will be updated once your order has been dispatched.
- To redeem a level reward simply present your card in-store or access the ‘My Rewards’ section of your online account.
- VIP Rewards require your VIP Rewards card to be registered and/or your online account activated with enhanced profile information.
- Below are the details and terms and conditions of the VIP Rewards benefits:
(a) Favourite Brand: VIP Rewards members receive 10% off their chosen brand when shopping in-store or online with a registered VIP Rewards card. Cannot be used in conjunction with any other offers. Favourite brand needs to be selected by you from a pre-defined list of over 60 brands and discount can take up to 72 hours to activate. Once selected the favourite brand discount is valid for 12 months during which time the chosen brand cannot be updated. After the 12 months you will be reminded that your favourite brand must be re-selected or updated for the discount to continue. Subject to availability.
(b) Free Delivery: VIP Rewards Members in the UK receive free standard delivery shopping online at www.theperfumeshop.com or through The Perfume Shop App with a valid registered VIP Rewards card. Subject to availability.

If your VIP Rewards card is lost, or if you think an unauthorised person has become aware of any security code, password or account number, you should contact Customer Services. - We may immediately suspend or terminate the rights of any member and/or close an account if:
- these terms and conditions are breached by you; or
- if we reasonably believe that you have acted in a manner not permitted by these terms and conditions; or
- if you engage in (or we reasonably suspect you of engaging in) any theft from or misconduct in connection with us or any supplier; or
- if you supply false or misleading information to us or we discover that you are not eligible to be a member of the Rewards Club programme; or
- if you are abusive or offensive to any member of our staff.
- You can also close your account at any time by notifying us in writing. If an account is closed for any reason, all rights to redeem rewards from that account are lost.
- We may make changes to these terms and conditions. If we decide to change these terms and conditions, we will seek to give you reasonable notice first by post and/or email at the address you have given to us. We may suspend or close VIP Rewards at any time but we will endeavour to give you as much notice as we reasonably can before we do so, by post and/or email at the address you have given to us.
- If The Perfume Shop Limited is sold or transferred to another company we may transfer all of our rights and obligations under these terms and conditions without any further consent and may disclose or transfer all information we hold about you to a prospective or actual new owner.
